repr esents that the employees already designated have agreed to be bound by s a id terms and conditions. Each employee yet to be
chosen shall be so bo und by said terms and conditions upon a greeing to accept his employment. Each employee may enforce this
agreement. The employees severally agree to render collectively to the employer services as musici ans in the orchestra under the

Upon re quest by the American Fed eration of Musicians of the United S tates and Canada (herein called the "Federati on") or
the local in whose jurisdicti on the employees shall perform hereunder, the employer either shall make advance p ayment hereunder
or shall p ost an appropriate b ond.
ADDITIONAL TERMS AN D CONDITIONS
If any empl oyees have not bee n ch osen up on the sig n ing of this contract, the leader shall, as agent for the employer and u n de r bill instructions, hire such
persons and any replacements as are requ ired for persons who for any reason do not perform any or all services. The employer shall at all times have complete
control over the ser vices of employees under this co n trac t, and the l eader shall . as agent of the employer , e nforce dis c ip linary m eas ures for just cause, and
carr y out instr u c tions as to selec tions and manner of performan ce. The agreemen t of the employees to perform is subj ect to pro ve n detention by sick ness , acci
dents, or accidents to means of transpor tation, riots, s tr ikes , epid emics, acts of God, or any o ther legitimate conditio ns beyo nd the con trol of the employees. On
behalf of the employer the leader will distribute the amount received from the employer to the employees, i n cluding himself as indicated on the oppos ite s ide of
this contract, or in place thereof on separate memormandum supplied to the em pl oyer at or before the commencemen t of the employment hereunder and take
and turn o ver to the employer receipts therefor from each employee, including himself. The amount paid to the leader includes the cost of transportation, which
will be repor ted by the leader to the employer.
All employees covered by this ag reement m ust be members in good s tanding of the Federation. Hof,ever, if the employment provided for hereunder ill subject
to the Labor -Managem en t Relations Act, 1947, all employees, wh o are members of the Federation when their employmen t commences hereunder, shall be continued
in s uch employment only so long as they con tinue such membership in good s tan ding. All o ther employees covered by this agreemen t, on or before the thirtieth
day foll owing the commencement of their employmen t, or the effective date of this agreemen t, whichever is la ter, sh all become and co ntinue to be members In
1rood s tanding of the Federation. The provisions of this paragraph shall not become effective unless and until permitted by applicable law.
To the exten t permitted by applicable law, nothing in this con trac t shall eve r be construed so as to interfere w ith any du ty owing by any employees hereunder
to the Federation p ur s uan t to its Cons titu tion, By -laws, Rules, Regulations and Orders. ·
Any employees who are parties to or affected by this co n tract are free to cease service here un der by reason of any strike, ban, unfair list or requirem.ent of
the Federation, and shall be free to accept and en gage in o ther employment of the same or similar charac ter or o ther wise, for other employers or persons without
any restraint, hindrance, pe nalty, obligation or liability whatever, any o ther provisions of this contract to the contrary notwithstanding.
Representatives of the local in whose jurisdiction the employees shall perform hereunder shall have access to the place of performance ( except to private
residences ) for the p urpose of conferring with the employees.
The performances to be rendered p ursuant to this agreemen t are not to be recorded, reproduced, or transmitted from the place of performance, in any man
ner or by any means whatsoever, in the absence of a specific written agreemen t between the employer and the Federation relatin&' to and permittin1r euch record
inK', reproduction or transmission.
The employer represents that there doee not exis t against him, in favor of any member of the Federation, any claim of any kind arisin1r out of musical aerv•
ices rendered for any such employer. No employee will be required to perform any provisions of this contrac t or to render any services for said employer u lone
118 any such claim is unsatisfied or unpaid, in whole or in part. If the employer breaches this agreemen t, he shall pay the employees, in addition to damqe a,
6 % interest thereon plus a reasonable attorney 's fee.
The employer, in eigning this con tract himself, or having same signed by a representative, acknowledges his (her or their) authority to do 10 and herebJ'

To the ex tent permitted by applicable law, there are incorporated into and made part of this agreemen t, as though fully set forth herein, all the By-laws, Rulea
and Regulations of the Federation and of any local of the Federation in whose jurilldiction services are to be performed hereunder ( insofar as they do not conflict
with those of the Federation) , and the employer acknowled1res his responsibility to be fully acquain ted, now and for the duration of this contract, with the con
tents thereof.
The employer hereby covenan ts and agrees to obtain and pay all and any lic enses and tees re quired to be obtained by or to be paid to Composers, Authors
and Publishers Association of Canada Limited or B.M .I. Canada Limited or any other person, firm or corporation legally en titled to require licensing and /or pay.
ment of fees, with respec t thereto and to indemnify and save harmless the employees and their representatives of and from any and all claims now or hereafter
made by them or any one or more of them with respect to the said en1rqement.
